ok so in most countries if a child sexts they can be charged and listed as a sex offender for producing and sending child pornography...as a child. that makes no sense. I mean they should be punished but they shouldnt be ruined because of a mistake. also does that mean if a child sends someone they dont know pics of them because someone asked for these pics would the child be charged?

No the person asking would be. I'm sure the child would get a slap on the wrist though.

doesnt it seem like a strange way to deal with things like this with teenagers being put on sex offenders lists for a mistake. I mean if that happened to me id probobly kill myself. I mean it just ruins a childs life for a mistake. it doesnt seem fair

If you want the truth:

It's the childs fault to be sending nude pictures of themselves over the internet.

If you don't want the truth:

Yes it's terrible to treat them like that.

Of course it's not fair. Thankfully, some politicians are starting to realize this and the ridiculous sexting laws are being overturned – but it's still much too easy to be placed on the sex offender list these days.

I mean, there's a gigantic difference between downloading child porn and raping children.

True story-

Two eight grade students obtained a picture of a nude eight grade student and sent it via text message to the entire grade. The original two were charged with trafficking child pornography.

This I can see... they spread it to the whole school so they were trafficking child porn. However if it's something between two people and not spread farther I think it's ridiculous to make them register as a sex offender. They're teenagers, it's puberty, they're gonna want to do something. If it's sexting or actual sex which is better?

Here's my thought.

If two teenagers want to sext between themselves and send explicit texts and pictures, they should be allowed to do that. It's better then going off and actually having sex, which could result in an unwanted pregnancy, STD, etc.

The minute that one of those original two sends it to someone else, however, it should be considered a crime. Keep it between the original two though and I don't see why they should be considered to be prosecuted.

Spot on :) Teenagers send sexual pictures to each other all the time, and no law is going to change that. When it starts affecting someone negatively, though, that's when the authorities should step in.

Welcome to america, the land of "Oh you sent a few pictures to a guy? Lemme add him to a list of people who have no possible future at all in this world."

i think if the two parties consent, then it should be legal i mean isn't it better to do it over pictures then in real life when you can actually get diseases and whatnot.
