So, I have this teacher who always keeps us in class at lunch and break time. Sometimes we miss the whole of break and when he keeps us in at lunch we miss about 15 minutes of it. He always says "I'll keep you in all night if I have to" when people are in a hurry to get out.
He waits until he's finished the topic or the notes we're taking, THEN he gives us our homework very slowly(he'd say "Right, now, homework! Describe(waits 15 seconds)....in detail(waits 20 seconds)..." he does it to punish us if we get impatient).
Technically we're not in his class anymore, if the bell rang. We're on our break and he can't keep us in, right?
Is what he's doing over-the-top and unfair?
Because I was thinking of telling him that we're technically not in class anymore and just leaving. But I just want to make sure it wouldn't be me in the wrong.
What's your take on what he's doing?

He CAN keep you in, all teachers can do that.
Yeah, it's unfair and idiotic but not over-the-top.
LAWL! One thing he DEFINATELY can't do is keep you in all night, or any longer than like an after-school detention (which you need to be issued one first) or 15 minute punishment (that you get given in that class. We have them here, don't know if your school does, and we call them ' U's '. Although, seniors don't get them.

One thing he DEFINATELY can't do is keep you in all night, or any longer than like an after-school detention (which you need to be issued one first) or 15 minute punishment (that you get given in that class. We have them here, don't know if your school does, and we call them ' U's '. Although, seniors don't get them.

it's just that our whole class has gone without lunch before. And I was under the impression that as soon as that bell rings you are no longer in that class. But ah well.
Nah, it's not punishment for anything big, so he couldnt go give anyone detention. Like, if the bell rang, and someone put their stuff away he'd get all angry and punish us all as a result.

Like Thomas said, he can keep you after the bell. You'rein school and in class, he can keep you. But he can't keep you after school. Why don't you guys just be patient and try to not act like you're in a rush and maybe he'd let you out of class in time?

If your class goes without lunch, THEN it's over the top. Yes, teachers are allowed to keep you in their class at their discretion, but if missing lunch becomes a regular thing, I would go to the deputy or head to express your concern.

I'd say, if this continues for long enough or gets worse, then raise it as an issue either directly with him or with senior staff members - but only if it affects other activities within school e.g. lunch (which is quite important).

Yeah, but you can get a bunch of teenagers to at least be a little quiet for a few seconds. But I agree with Symone, speak with him or other teachers/principal about it if it continues.

He can hold you in class for more but not over night. If I had everything I needed from him, I'd just walk out, but you guys have to be patient so that he stops doing that because he get's pissed that you guys start packing up without letting him finish so just let him and maybe he'll stop keeping you guys overtime.

As others have said, if this continues, you've got to report it he has no right to keep you from eating.

We don't act impatient. He keeps us in anyway. But IF we act impatient he keeps us in longer.

I would do as others have said ang go to your head of year or something.
I think please correct me if I'm wrong, but by law you only actually entitled to a 30 minute lunch break even though most schools give an hour however I still agree it's unfair and unnecessary.
As for keeping you in after school I don't think he can keep you any more than 15 minutes legally without giving parents 24hr notice or seeking permission from them.

Hey Im 14, got a teacher like yours but not on such a scale. As far as im concerned he cannot keep you in like that. Walk out and dont look back. (As long as you have done nothing wrong.) Our geography teacher keeps us back after we sit and listen to him ramble on for 50 minutes, then he gives us a double sided sheet of A4 paper and tells us we've got 3 minutes left and it has to be done. Then he says "You do the maths." We do not misbehave in is his class. I never stay behind unless he has a reason for it. Once he told he head teacher I walked out and I told the head that he was being unreasonable and I'd done thing wrong, Head disagreed at first but when he asked the Geography teacher what I had done wrong there was no reply. I walk out his class when the bell rings every time and theres nothing he can do about it. But make sure if you DO do something wrong you do the detention. (Also if you have been missheaving you are still legally required 15 minutes to eat your lunch and you cant be held back for more then an hour after school. Hope this helps :D

He cant keep you in all lunch. Legaly he has to provide fifteen minutes for pupils to eat.

No, no, no he can NOT keep you in all lunch. Its illegal. You have to be provided fifteen minutes to eat lunch. You tell him that an walk straight on out.
