A PAIR of blundering police officers mistook a lawyer's cigarette break on his window ledge for a suicide attempt.
Manhattan man Mark Moody sued the city and the police officers for $400,000 in damages earlier this month after he was wrestled to the floor of his apartment, handcuffed and taken by ambulance to a downtown psychiatric ward, The New York Post reported today, citing evidence in a lawsuit.

The 40-year-old trial lawyer said he was sat out enjoying his regular nicotine hit on the sill of his second-floor apartment window, a scant 3.5m off the ground, on a hot August day when a police car arrived and two police officers jumped out.

"Are you about to commit suicide?" one officer asked.

"If I was going to commit suicide, this would be a pretty dumb place to do it," the smoker replied, adding. "If I jumped from here, I'd just sprain my ankle."


But the officers, who never said what prompted their concern, insisted Mr Moody come downstairs.

The lawyer refused, explaining he was sitting on the sill so he wouldn't get smoke in the apartment, and hailed a cabby friend over to vouch that the window was his regular smoking spot. But three ambulances and four other patrol cars pulled up before the cabby could move.

Mr Moody said that before he knew it, a beefy officer was inside his apartment, lifting him out of his own living-room window from behind. The lawyer was then shifted into an ambulance and taken to the Beth Israel Medical Centre.

But Mr Moody said the on-duty psychiatrist apologised before quickly discharging him.

"I talked to him for three minutes, and he said, 'Look, I'm really sorry. I apologise on behalf of the city,'" Mr Moody recalled.

NYPD spokesman Paul Browne said, "Police responded to a 911 call of an emotionally disturbed person at the location. When police arrived, they observed the male sitting on the ledge talking erratically. Police Emergency Service officers were called, and the person was removed to the hospital for observation."

And this is why I truly believe that 65% of law enforcement officers are arrogant. Just because your supposed to follow protocol, doesn't mean you should forget about thinking rationally and acting on the protocols behalf.

Also, I wonder if it had ever occured to the two dumb shits to ASK the man what he was doing. Communication. It works wonders.

Exactly. If cops actually followed common sense, and threw procedures out the window for trivial things like this, then there would be SO much less shit like this happening, Also, like you said, communication helps a lot.

(No, I am not saying suicide is trivial, but if it is obviously not a suicide, but you follow suicide procedures, then it kinda makes it trivial.)

I'd hardly call this anything. He was basically assaulted. I'd say the lawsuit is well deserved.

So. He doesn't deserve 400 grand that the city probably needs for improvements. Oh, boo-hoo. The police thought he was suicidal since they had a call that there was a suicidal person in the area, and he was standing on the balcony. Sure, they shouldn't have been so aggressive, but he doesn't deserve four hundred thousand dollars. It's people like him who fuck up things for others because of their greed.

Do you think the police would change whatever policy lead to this joke of an incident if they didn't have to pay a bunch of money when things like this happened? I don't.

Yeah, the guy doesn't deserve that much money, but he certainly deserves some amount to compensate for his rights being violated, and the amount needs to be large enough to make the police and city pay attention. I'd personally peg it at somewhere between 50,000 and 200,000, but it's not like he's some horrible person for asking for more: you always try and get more damages than you deserve in a lawsuit, if it's frivolous the judge will reduce the damages.

There are no laws concerning a person who is going to commit suicide. All that officials can do is try to stop the person trying to kill themselves. he only trouble is that the city has to clean up the mess after if the person DOES jump.

It creates a lot of negative attention, and I'm sure the chief and mayor don't want that. I don't understand why people need money to compensate losing an hour of their time. I doubt it lead to an costs on his part.

By him doing this, he's teaching them that they are accountable and that wrongly abusing a man like this costs them a lot. After this, the police will think twice before kidnapping a man having a smoke in his window.

You can't put a price on having your rights violated, but it's the only way that they can make amends to him.

How was hundreds of thousands of dollars wasted by them just apprehending him and then taking him to a therapist? If they did waste that much money, how does him suing make it better? That makes things worse. Now they're losing even more money.

And if losing more money is the only thing teaching them to think rationally, and to be held accountable for there dumb shit decision, then sue away. Fuck the city, who cares where they get the money from. So the people will have to drive over a few bumps on their way to work, it's not like it's destroying lives. A little inconvenience of the people is worth the lesson this cities law enforcement so clearly needs to learn.
