child porn or art ?

Well I was wonderng what is the bondary between child porn and art with a nude child you see in famous art nude children however it is not hidden like ones known as child porn and some times you even see some pop up as kids play and such in photos with parents and crap.

I am a artist aswell and was just wondering how they decide whats what O.O ?

The above is just a personal definition. Anyone can look at a picture of a child in a swim suit and can say it is a sexually provocative position. It all depends on personal takings and definitions. Deciding whats what is really hard to say, namely because you could show two people a picture of a child in a swim suit and one will say it's art while the other says it's pornography. Pornography ITSELF is a photograph/video showing a person performing a sexual act and/or taking a sexual position.

So what If I wanted to draw nude child for something in my art such as a homeless starving kid no money nothing, um being attack losing lots close not all pics showing any private parts but in general would any of that be against law or is it only as you said for stuff such as sex vids or trying to do sexual poses ?


I tend to like medieval stuff and back then it really wasnt much of an issue so idk i understand the sexual stuff but if its just for being naked sorta dumb its natural ....

I am learning to draw human body and threw doing so I have totally grown a diffrent thought pattern torwards it as others see it as perverted or something Ive come to think of it as cool art and awesome natural engineering lol idk I know many cases that a child that had few or lil cloths would be a good part of a piece of art Im not going to list them cause im to lazy. Im not saying im just going to go drawing lots kids lol just want to know what the limits are so i know and have a basic understanding of what i can do when coming up with diffrent artwork.

Before you say this on the matter of the legality, maybe you should read the statutes first?

(a) In General.— Any person who, in a circumstance described in subsection (d), knowingly produces, distributes, receives, or possesses with intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that—

(A) depicts a minor engaging in sexually explicit conduct; and
(B) is obscene; or

(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and
(B) lacks serious literary, artistic, political, or scientific value;

To be charged with anything like child pornography, it'd have to, at min. reach those requirements.

Matt and I have the same ideas on what child pornography are. A lot of people have pictures and videos of their children nude because, y'know, they're doing something that involves them being naked, lol, and that isn't CP because it isn't sexual. Pornography itself is for sexual purposes with the people doing sexual stuff. Look at Renaissance art. Bunch of nude babies. Even though it's art and art isn't censored, it isn't CP because of obvious reasons.
