okay so at school i was just wondering what rights you as a individual have. what rights do you no longer have? also do schools have the right to take away your cell phone if your texting?

If you have any law or civics teachers around, ask them. They should be able to tell you, or, at the least, point you in the right directions as to where you can check up on your (since you live in the US) constitutional rights and other rights that may be granted to your particular state.

In my school, if we are caught with a phone during school hours, its taken and they charge you $5 the first time, and $10 the second time to get it back. After that you have to give it to the office before school, then they give it back at the end of the day. Its a bit excessive I think. Its the year 2009 (almost 2010), we should be allowed to at least carry our sell phones with us. We can't have any electronic device whatsoever with us during school hours.

My school is fine other than that (and the lunches :P); only if you interrupt the teacher will they bite your head off :D

You still have all the rights that you previously had, the only difference is that there are now additional rules or guidelines. The rules don't infringe upon your legal rights. For example, in a school, you can legally curse all you want, the school cannot prevent you from doing that, however, they can impose certain consequences on your profanity.

For the cell phones, schools and universities do have the right. At university, during a test or exam, having a cell phone on your person is considered an academic offense and the university has the right to confiscate it and potentially fail you on your test or exam. In school, I suppose similar rules apply although they cannot keep your phone indefinitely, they have to return it to you. The time when they have to return it is either decided in the rules or is up to the teacher's discretion but the most they can hold it for is one academic year although generally they tend not to do that. I think it would also depend why you were texting and how often you were caught. If you were caught texting but were helping out a friend in peril, then I think the school may be more lenient than if you were helping someone cheat on a test.

If you want to know a more accurate amount of time for keeping a phone, then I'd ask your principle or look up the school's rules.

in my school if your phone rings it gets confiscated and if you cant come up with a reason it gets confiscated for the term or week 5.

I was told that school is federal property, and us as minors have no rights, especially on federal property! So go figure our rights....

You will have more rights than you think. Best bet is to speak to your student advisor's / information point. They will probably be able to provide you with information.

Also in your case while the property may be under federal law, chances are the staff are not. Teachers are not agents of the law so will not affect any legal rights.

K, depending on what kind of school your in will depend on how much you can get away with, remembering you dont want to get on the bad side of some teachers. We arent allowed cell phones and ipods unless the teacher says we can have them. But also as soon as you start going on to a teacher on how they cant touch you and stuff there are other ways to get back at you. Back in the day in my school a teacher/coach had his "boys" (vball and basketball players/athletes) that did everything for him. When he had a problem with a kid his boys took him behind a shed a wooped him, the kid never did anything bad again. And whenever a kid went and tried to get him in trouble with the school and stuff one of his boys would take the rap for the whole event.
