No, of course you're not a rapist! The issue is intent: Why you did it. It doesn't sound like you intentionally violated him, the purpose wasn't to hurt him, or to be aggressive or hostile! Rape isn't just a sexual crime, it's a violently, aggressive one that involves sexual exploitation and violation. It's purpose is to profoundly hurt someone. The sexual part is the way to accomplish that.

My bet is that you were curious, your intention was to satisfy your curiosity. Curiosity can sometimes cause us to show not so good judgement, but that's not the intention, the reason why you did it.

I dont know if I understand the question. You say you masturbated with your brother, if thats the case, whether you just did it in the same room as each other or if you jerked him off you can't have raped him. Doesnt make any difference how old he is (although I'm not saying its ok to j/o little brothers!) Rape means to force somebody to have sex involving penetration, so unless you did that its not rape. It could possibly be seen as assault though, depending how old he is and how willing he was and even if you were both up for it I dont think its a very good idea

Let's forget about age here, for the most part. The key definition of rape is that it is non-consensual. The other person is either threatened or physically forced into it. It sounds like you and your brother were just curious, it's a very common thing for siblings to do together around that age and even younger. Unless your brother was too young to know what was going on, or you pressured him into it against his will, there is nothing wrong with this.

That's nothing like rape! Don't worry about that. If he said no, then there would be a problem. But from what you said, it doesn't seem like either of you forced the other to do anything.

Although if you drugged him or knew he was on drugs it might be considered rape.... But I'm hoping at twelve no one is doing drugs.
