okay here we go,

ive been wondering if there's any way to get a theme for your ipod touch without "jailbreaking" it. I have no idea wat jailbreaking is, how it works, or how to do it. ive also heard that it can damage your ipod, so im not going there, but, back to the topic, is there any way to get a theme for your ipod touch without using any illegal/harmful programs??????

No. There is not. And a 2G jailbreak is not available right now, but it is in development and should be released soon. If you have an old iPod, you can jailbreak it.
