Build a genuine relationship, based on both emotional and physical attraction. Remember, emotionally is still important or your relationship will not work out.

First, if he isn't gay, don't bother with a relationship. Try experimenting.

If he is:
Not gay:
Become friends, after a while have a sleep over and masturbate or something and build up on that.
Gay:
Become friends and ask him out/ have a gradual relationship build up.

Also consider if you are ready for sex, and if you will regret it. The law, actually does matter.

^ Pretty much what Donkey said, just have a plan B ready to action if he turns you down so as not to burn the friendship.

Also helps to have a plan C for if you guys do get it on but have second thoughts or regrets after, that saves a lot of time being embarrassed and avoiding each other for a long period of time.

anyways, are you sure you are gay or bi and not curious? if you love guys emotionally and physically, then you are gay, if you love both sexes emot+phys then you are bi, and loving guys physically means you are curious, and you get a boner when you look at them. anyways, it would be called experimenting (doing it with another boy), and it's perfectly normal. but if you do ask him, it can end up badly. Jon (donkey) already said what can happen. also, how old is he? if hes like 19 and your 13 then its illegal and you shouldn't be doing it.
