However I'd like to add that despite what the law says on paper, sometimes it comes down to how the lawyers argue for or against your case.

At my school there's a couple with only 1 year age gap and they were dating prior to the guy hitting age 18.

They were sexually active the whole time of the relationship, but the girl's dad and mom didn't like him.

So when he crossed the age 18 threshold, they had him prosecuted.


It was the talk of the school for a while.

Long answer: 12 is absolute lowest age. 12-13 year olds can only have sex with someone 12-13, same with 14-15 year olds. Once you turn 16, you can have sex with anyone else 16 or older, as long as they're not in a position of authority (teacher, boss, etc).

But here's something strange: You must be at least 18 years old to have anal sex, unless you're at least 16, and you're married to the person you have anal sex with.

After a quick google search, In the Commonwealth of Virginia, Age of Consent is 15. BUT, that only applies is a 15 y/o is having sex with another person that is 13-17 y/o. If one of the persons involved is 18+ y/o, legal actions can be taken.....

Soooo... to put that into simpler terms, an 18+ year old can legally have sex with someone else 18+; and someone 13-17 years old can legally have sex with another 13-17 year old.

According to German law you count as a "child" until the age of 13.
From the age of 14 until 17 you count as a "adolescent"
From the age of 18 you count as an "adult".

Sex with a "child" is illegal in any case!
So if a 14yo has sex with a 13yo it is illegal, but usually authorities relinquish prosecution in such a case unless it happened by force. But if it was sex between an adult (18yo and older) and a 13yo it is prosecuted even without the child or its parents charging! Sex between 13yo and 13yo cannot be prosecuted because the age of criminal responsibility is 14yo in Germany

If an adult (18yo +) has sex with someone 14/15yo. it is only illegal, if one of the following conditions is the case:
> The sex did not happen consensual
> The younger person was payed for making sex
> The adult took advantage of a predicament
> The adult was at least 21yo and took advantage of the adolescents gullibility/inexperience.
Authorities do not prosecute such cases without someone having charged the adult. The case is dismissed, if the charge is taken back.

If the "adolescent" is 16/17yo, sex is legal, if it was consensual. The age of the sex partner does not play any role.
If you are 16yo you also may get married, but you need the official permission of your parents until you are 18yo.


By the way:

From 16yo you may drink beer and wine. Harder alcoholic drinks from 18yo.

After having passed the respective driving test:
From 16yo you may drive a moped.
From 17yo you may drive a car with being accompanied by your father/mother.
From 18yo you may drive a car alone.
From 18yo you may drive a motorbike with max 125ccm. Stronger motorbikes from 21yo.

From 18yo you may vote at elections and may be candidate for German parliament ("Bundestag") and European Parliament. In some federal states of Germany you already may vote at the age of 16 at elections for the state parliament ("Landtag"), county parliaments ("Kreistag") or town council ("Gemeinderat"). In the federal state "Hessen" you may vote for "Landtag" 18yo but only be candidate 21yo.

It used to be 12, I believe, but I keep hearing that it's changed from different people. However, telling my doctor and therapist that I was sexually active at age 14 didn't get me in trouble so that obviously wasn't against the law. It would be different, however, if I were having sex with someone 18 years and up. I'm assuming that you can have sex at pretty much any age as long as they're not 18, and that only changes when you turn 18 yourself. Once you're 18, it's illegal to have sex with someone younger than you but there's no restrictions otherwise. i.e. 18 year old and 30 year old =/= illegal.
