Hi. Im a freshem and im 15, and my gf is a jr. and shes 16. we've been goin out for 3 months now and are thinking about having sex for the first time. Anyways, today I had to visit my counselor about me going to the prom with her, and she was like are you aware that there is a significant age gap between you two and im like no its only a year and then she starts talking about statutory rape and how u go to jail for it. Is that really rape if its consentual? And its not like shes not a minor to. Thanks.

I can better answer your question if you tell me what state you're from because the laws are different in each state.

Massachuetts and the age of consent is 16, but there must be exceptions right?

No there aren't any exceptions. 16 means 16!
So I recommend that you wait until you're at least legal age. You're going to have a whole lifetime of oppurtunity for sex so there is no use risking getting her and yourself in trouble.
Risks like pregnancy and STDs will already be there when having sex and you don't want to add breaking the law into the mix. At the very least wait until you're of legal age and always protect yourself.

Also, if your relationship cant last for another year with her then maybe you should not have sex with her. If you guys can't be in a relationship for a year then I don't think that you guys' focus should be sex.

Its only if your parents press charges. For example, you (15) have sex with ur gf (16) and your parents dont accept, then they can press charges and have her put behind bars.

Personally I'd advice not breaking the law... Specially when your both young and have the rest of your lives... One mess up could be horrible, like if your parents or her parents didn't agree and decided to press charges against each other...

this is definatly considered rape. i was watching the news and a woman teacher went to jail for like 3 years after having sex with a student who wanted to so yah wait a year and have protected sex

play the safe game. Think how many times you can have sex legally when youre 16 as opposed to potentially throwing it all away with one.

ok but wouldnt I or my parents want to press charges? they wouldnt do that..

However you've gotten a counselor involved and in the know. The prosecutor can press charges still. I think counselors are legally required to report illegal things.

In most jurisdictions, they are required under 13; 13 or older, the victim can request that they don't and then they are ethically obligated to not. They could lose their license if they do.
There are exceptions for imminent risk of harm.

yah but look at the age difference a teacher and a student compared to a 15 year old and a 16 year old im pretty sure u can have sex with someone under the age if one of u are of age i think it just has to be no more then one year less
