There are a lot of websites out there regarding this story (I am also new and am not quite sure what I can and cannot post as far as links go). Anyways, the short story is Red Bull is being sued because of the advertising claim, Red Bull gives you wings. The company is being sued for around 13 million. I am not sure if it is going to hold up, but if it does, if you can prove you brought a Red Bull in the last 10 or so years, you are reportedly going to be able to get $10 or $15 in Red Bulls.

I am just thinking how stupid do you have to be to actually believe Red Bull is going to give you wings. I am also wondering if this is going to open the door on more stupid law suits.

Anyways, for those of you who like Red Bull, you may want to keep your eyes open, because you may be able to cash in on this.

You can post links to pretty much anything that's not triggering, graphic, or pornography. Basically anything that's not illegal or harmful. You can read more in the rules, which is the FAQ linked in my signature.

I can't believe that's an actual thing someone's suing them for. Talk about grasping at straws.

Red Bull says in its marketing that the drink can improve concentration and reaction speeds, but the plaintiff in the case said these claims were false and lacked scientific support. While the suit did not allege that plaintiffs were disappointed that they didn't suddenly sprout wings, it does say that Red Bull relies a lot on terms like "wings" and "boost" to give consumers the impression that the drink gives people some sort of physical lift or enhancement.
If the proposed settlement is passed by the US District Court of the Southern District of New York, where the case was brought, Red Bull will be required to pay $6.5 million into a settlement fund within a week.
The settlement says Red Bull will reimburse customers disappointed the energy drink hasn’t lived up to their expectations with either a check for $10 or a voucher for $15 worth of Red Bull products. This could prove costly, as the class action suit covers the millions of people who have bought at least one can of Red Bull over the past 10 years.


Wow, this is legit.

I guess it is possible it won’t be upheld. I agree with what everyone has been saying though. I can only imagine this will just open the door to more lawsuits down the road over some pretty outlandish things.

It kind of reminds me of the two girls who tried suing McDonalds because they said it was McDonalds fault they were fat (I watched the movie Super Size Me). A little different of course, but another example of just sheer stupidity and also shows what people will do to try to get an extra buck.

I just wonder whether the credit's worth anything when it comes to Jaggerbombs.

Of course no one believed it gave you wings, this law suit is just someone looking to make an easy buck, thats it, a reaterd contrubuting to the culture of "If you don't like something, sue someone....anyone"

This is crazy, I don't know why they are suing. They say "it gives you wings", mean it keeps you energized.

So Skittles taste the rainbow, is the candy really made from a rainbow? No it isn't. That's just their tag.

So basically you put your information in, and when they sue and win, everyone who signed up gets a share of the moneys they sued for in the mail. I know because my mom's work, the company sued for an issue at her job and they all got paid equal of what they sued for. So everyone at her work got forty dollars or something like that.

But I can't believe this Red Bull lawsuit, and I don't think anything will happen because of it.

Drinks giant Red Bull GmbH must pay $13m to settle the suit, $6.5m of which will go into a fund that will be paid out to an estimated 1.4 million consumers, who can apply for the refund through a specially created website.

“Red Bull settled the lawsuit to avoid the cost and distraction of litigation,” a spokesman said. “However, Red Bull maintains its marketing and labeling have always been truthful and accurate, and denies any and all wrongdoing or liability.”

But the class-action lawsuit, which began in January 2013, cited evidence in The New York Times, Nutrition Reviews and the European Food Safety Authority Journal that indicated energy drinks provide their boost through caffeine alone, not guarana or any other ingredient.

As a result, Mr Careathers argued, Red Bull’s performance-enhancing properties could only be tested by the quantity of caffeine in each can, which worked out more expensive that a cup of coffee from Starbucks.

And despite the hype There is a March 1st 2015 date set for a final court approval hearing.

Irony at its best - Red Bull did not work - no wings no edge etc so we will give you more freebie as a settlement.

I don't see the point of tiny little chickenshit payouts like this. there was a similar lawsuit filed against Pepsi last year over something with the marketing of one of their juice products, and everybody who joined the suit got like 10 bucks just like with this Red Bull suit. if it doesn't involve people being injured or killed or ripped off big time, what's the point? just fine the company for deceptive marketing (IF LEGITIMATE, not for something gay like this) and go on.

As for an actual response to the thread...
I'm not to knowledgeable as far as lawsuits go, but whoever is trying to sue Redbull, knows damn well that it doesn't actually give you wings. They saw it as "false advertising" and thought they could make a quick buck. It's really no different than the lady that sued McDonald's because there was no "warning hot" label on her coffee.

EDIT: I find it kind of funny and ironic that I started my day with a redbull and then saw this thread... :lol3:

It's really no different than the lady that sued McDonald's because there was no "warning hot" label on her coffee.

actually, she sued because the coffee was so hot that it gave her third-degree burns and required skin grafts. McDonald's (the billion dollar company) rolled a few nickels her way but not enough to cover her medical expenses, hence the suit. it's kinda ironic that a legitimate lawsuit entered urban legend as an example of frivolous lawsuits.

The wings thing is just a stupid gimmick to get you to buy the product. Just think about it - M&Ms can melt in your hand if you hold them tightly or if you're outside with them on a hot summer day, despite the commercials saying that they melt in your mouth, not in your hand.
