I recently sold a new pair of Levi jeans on eBay. The Levi jeans say in the label that they are a size 24.
This was the size I advertised them on eBay. They where sold but now the buyer has emailed me asking for a full refund including postage and packaging but saying they will not return the item.
There reason for this is apparently that they measured the jeans and they are actually a size 26 and therefore she could not wear them. However she even acknowledges in her email that the label says otherwise. She also said I should have measured the jeans? I also stated at the point of buying that there where no refunds.
This really isn't my fault and this is my first time selling something on eBay so I don't really know how this works. I messaged back stating the reasons why I would not be issuing the refund (the jeans are as advertised by Levi themselves and I stated there where no refunds). What will happen if she takes this further? Will she be able to get a refund from ebay? Because if so I have lost money especially if she doesn't return the item.
I don't feel like i'm being fairly treated at all but don't know what to do?

My mom who's been on ebay forever said:
The buyer will have to file a claim and it will be up to ebay to decide.
Most likely they will tell the buyer they have to return the item.
You can offer to cover the cost of shipping if you want to avoid negative possible feedback.
You don't have to measure stuff that's clearly labeled, but it helps avoid these problems.

Thanks but i'm not entirely convinced the user didn't just change her mind and thought she'd have a go at getting a refund when it says refunds are not available.
If i'd measured it as a different size then labeled and then listed it as a different size than labeled that'd would have been false advertising!

That's why there needs to be a claim filed. Ebay will probably tell the buyer they have to keep the item. Returning cause you changed your mind is against the rules I think. I'm not sure how well no refunds option holds up if the item is not as described like the buyer is claiming. But you have not done anything wrong. You have listed the item correctly and you are sticking to your stated no return policy, which the buyer automatically agreed to. It's up to the buyer to convince Ebay.
You should list the item according to the label size, but you can also add the measurements you made in the description. That just helps you avoid something like this. Its a good idea to see how ppl who've been selling a long time with good feedback list stuff and copy their methods.

She would have to file a claim in ebay. They then take up to 28 days to rule one way or the other. However, if she does want a refund, she would have to return the jeans. I'm not sure on the rules of P&P as to who pays what. A lot will depend on weather Ebay will believe weather the item is as described or not.

I'm not sure if UK's eBay's policies are different from the US... here's what I'd do...
Usually in the US eBay tends to back the buyer (yeah, I know, bs), so if you want to save yourself the claim trouble, tell them that if they want their money back, they can send the jeans back FIRST and THEN you will give them a refund. DO NOT REFUND THEM UNTIL YOU HAVE THE JEANS BACK IN YOUR HANDS.
It is not even 1% your fault that you did not put measurements, because you aren't required to. See should familiarize herself with the fit/style of Levis size 24 before she buys them. Sadly, if the buyer opens a case against you, eBay USUALLY tends to rule in their favor (even if you can prove the jeans were a 24) because that's just how eBay is- they suck up to the buyers and let the burden fall on the sellers. So save yourself the claim troubles and offer her to return the jeans (she should pay return shipping because she is returning them simply because she doesn't like them/isn't happy with purchase), after you get the jeans back, then you can refund her money- that's how that works.
I know you stated no returns, but if you plan on keeping that account, selling more, and maintaining a good feedback, sometimes it is just best to do so then risk getting bad feedback over something like a pair of jeans.

Umm, it says 24. And you said no refund. It's her fault and Levi's fault mostly. She should have tried out the jeans at a store, and what if diferent measuring scales are used where she lives?

Well it's my boyfriends account and we where planning on using mine from now on when selling so really, the negative feedback isn't going to be a problem :p
She's demanding a refund including shipping price which no way on earth is she getting. We still had to ship the bloody product. The best she is getting is a refund for the cost of the item and she can send the jeans back.

If the tag said "Size 24" and you advertised it as "Size 24", it will not be your fault.
It is up to the buyer to make some research that the size in the brand they are buying is right for them. Because different brands have different measurements and she should have made sure of or at least asked for the measurements.
With the refund, it is standard that you have to send the item back for you to issue the refund. Usually, the shipping cost is non-refundable and it is the actual item that gets refunded. Do not refund unless she actually sends the jeans back.
You should also ask on the eBay forums, they can be really useful there. I believe the UK version is located here (http://community.ebay.co.uk/t5/Discussion-Boards/ct-p/13).
