Would this be wrong?

Ok so I've been friends with this girl for a couple of months now, since like february, and I'd quite like to ask her out. I'm sure she likes me back because we've become really close (we talk alot, laugh, hang around). But here's the thing. I am 16, and she's only 13. So, would it be seen as wrong/creepy if I asked her out?

I should say I don't really have, or can't say because I've been in illegal "rationships", that I have a problem personally. But it would be a horrible scenario if he ends up in jail.
