The surviving suspect in the Boston Marathon bombings has been charged with using a weapon of mass destruction, the US Department of Justice says.

Dzhokhar Tsarnaev, who was charged in hospital, could face the death penalty.

A White House spokesman has said Mr Tsarnaev will not be treated as an "enemy combatant", as suggested by some Republican members of Congress.

The twin bomb attack near the finishing line of the marathon killed three people, and injured more than 200.

Dzhokhar Tsarnaev, 19, was captured on Friday evening after a huge manhunt during which his elder brother and suspected fellow bomber, Tamerlan Tsarnaev, died.

its bull shit because they aren't putting him on trial because he has a bullet wound on his throat. what kind of country is this if you can't even go on trial.

A magistrate judge was present when the 19-year-old was charged of conspiring to use a weapon of mass destruction.

The college student from Chechnya will be prosecuted through the civilian justice system and not as an enemy combatant.

White House spokesman Jay Carney said: "He will not be treated as an enemy combatant.

"We will prosecute this terrorist through our civilian system of justice. Under U.S. law, United States citizens cannot be tried in military commissions."

The Boston Marathon bombings killed three people and injured over 180 when devices were detonated near the finish line of the 26.2 mile race last Monday.

According to University of Notre Dame law professor Jimmy Gurulém, the suspect could face the death penalty because fatalities resulted from the attacks.

They are putting him on trial.

I think you might have mixed up "charging" and "convicting".

charge: a formal allegation that the person committed a crime (not proven guilty)

convicted: proving someone guilty of the charges.

sentencing: giving the punishment for the conviction.

You are charged without a trial, not convicted. Charges must be made before a trial can even happen.

My opinion about his trial: let him talk, then kill the sonuvabitch. But, on topic, good thing they charged him right away. Instead of waiting to see whether he was competent to stand trial, they just throw charges on him nice and fast.

It's kind of obvious he did it. I mean, I'm all for fair trials, but I really don't see how it's necessary especially because he has a bullet in his throat and may die. Still, I hope he does become fit enough to question first, so that they are able to see if he was part of another organisation or if it was just the plan of the two brothers.
