Minutes ago, Tsarnaev was located and aprehended in Watertown MA.

Dzhokar Tsarnaev charged with conspiring to use weapon of mass destruction against persons and property in U.S. resulting in death
The statutory charges authorize a penalty, upon conviction, of death or imprisonment for life or any term of years.
I'm curious as to how the death penalty can be authorised in a state where the death penalty isn't even legal? Putting all things aside about Tsarnaev, how can the US Legal System make such an exception? By doing so, surely they are undermining their own system? Although, there's probably something I'm not aware of about US Law that perhaps legitimately authorises such a penalty. Could someone shed some light?

The death penalty is illegal in Massachusetts for state charges. However, the terrorism charges are federal, and this overrides the state laws.
