Just because it's black and rectagular, and near the same size, doesn't make it a rip-off. They are two different companies, two different operating systems and contain different features. The Blackberry 10 still has all the nice functionalities that BB OS usually has, its just a lot more touch friendly. BB OS is also much more customizable. If you're going to argue something at least have relevant points to make.

And when it comes to the consumer who just wants a smart phone with good apps that exist in the Apple store, who cares if you can change the colour of the notification manager, icons/labels of apps, or the tint of the dock?

Maybe someone that also cares about the price.

Blackberry hasn't been able to keep up since Apple and Samsung started raking in cash. It's a cute effort, but I doubt it's gonna be a huge success.
