In news that Detectives overlooked a Google Search about ''fool-proof suffocation'' that Casey Anthony did on the last day that Caylee Antony was seen. With this new evidence, do you think that Casey should be retired?

PS: Before the whole ''double jeopardy'' thing starts, that only applies to the people who originally charged her - the State of Florida - and not to the Federal Government. The officers in the Rodney King fiasco were recharged by the Federal Government after they were acquitted by a jury in California.

Personally, yeah, I think that Casey Anthony should be retried with the new evidence. Do I think she will be convicted this time around? I honestly don't know. It's a substantial piece of new evidence, but at the same time, she was able to get out once. Her lawyers were able to make their argument effective enough for her to be found innocent in a trial that was highly publicized. I guess we'll see what these coming months bring though.

The Federal Government cannot prove that Caylee Anthony died via suffocation. In fact, the Federal Government cannot prove that she died via any actual action taken by Casey Anthony. There is no cause of death.

Is she probably guilty? yeah

Can the state PROVE beyond a reasonable doubt that she is guilty? nope, the evidence does not exist.

There just isnt the physical evidence to convict her.

I mean with the current evidence, prove Casey's Father did not make the search and carry out the murder ...

the evidence just isnt strong enough.

Exactly this. There's too much probability in a case like this to make any conclusive judgement. Retrying this case would only bring Casey more attention than she needs.

That's circumstantial evidence at best, not grounds for a retrial.

I'm not totally familiar with the Casey Anthony case but was she declared innocent?
In the Netherlands and other EU countries once you are declared innocent or have received punishment for something you can never ever be tried for that same crime again, even if their is a ton of undeniable proof (ne bis in idem).
I doubt it's much different in the US.

Although I think that is important evidence to come up with. The prosecutor had plenty of time and ability to get all the evidence he should have needed to convict her the first time. Just because something shows up later shouldn't mean they get a free pass to try it all over again.
I'm not trying to defend her either, because she could very well be guilty, but we have to prove that without reasonable doubt and so far I don't see that is the case here.

No i don't believe she should be retried. Although she's probably guilty, there isn't enough forensic evidence to support it.

Only if we want to go through another dog-and-pony show and waste taxpayer dollars on this. Of course, if we do, maybe someone will get pissed enough when she gets off to take a shot at her.

Doesn't violate the DJ rule. I just don't think we could convict.
