Scene: A mother is talking to one of her friends outside and her little 3 year child is with her playing with a ball. The mother is not paying attention as she is having a conversation with her friend, the ball lets loose from the kids hand and rolls into the street. The Child being 3 naturally goes after the ball, as the kid goes into the street a car is speeding down the block and hits the kid...
Who is MORE at fault...The mother for not paying attention or the driver who was speeding?

Well even if the car hadn't been speeding, the driver could still have not seen the kid and hit him. Assuming the kid is dead, I blame the mom.

i blame the mom, it takes a long time for a car to stop and the child would most likely have been killed regardless.

I blame the property owned for not putting up a fence.
I blame the property owner(s) for not putting up a fence. Children must be fenced at all times. =)

The mother. It is the driver's fault for endangering pedestrians, but for the actual injury of this specific child, it is the mother's fault. It is her responsibility to ensure the safety of her child and she failed to do so because she was too preoccupied.

Both the mother and driver. Assuming the driver saw the kid and didnt stop anyway. But if the driver didnt see the kid, then the mom is all to blame.

the blame should be as follows:
mother - 70% the mother should have been watching and if she had would have avoided the collision all together.
driver - 30% if the driver wasn't speeding there may have been a chance that the kid may not have been hit.

haha i though it said scene kid gets hit by car.
i blame the city for not putting speed bumps in the street. i think all neighborhoods should have speed bumps. then the car would not have been speeding and he would have seen the kid running and stopped. but then i put more blame on the driver than the mother. he was speeding and didnt see the kid. a good driver is aware of his surroundings. theres a reason there are speed limits in neighborhoods, so you dont hit children.
a mom can't just watch her kid forever without diverting her attention to something else for a few seconds. even if she was watching, the kid still could have not heard her call or payed attention and still run after the ball. then it wouldnt be her fault because she did what she could to stop him, but he still got hit.

Partially the mother's fault. I'd be pissed if it was a hit and run though. If the driver drove away, all guilt dropped on the mother would instantly disappear, because people would be mad at the driver for driving away. If the driver stopped, people would look more towards the mother. It's still mostly the mother's fault, but if the driver was not speeding the injuries may not have proven to be fatal, or at least would have been of lesser severity(presuming the child was killed by the speeding car).

If the driver saw the kid, it's his/her fault. If they didn't then its the mothers fault. But what kind of mother lets a kid walk into a street, even if talking? Whats hAppENinG!!!!!!!!!!!!! *()%_(^Y_&^*((+

Guys, guys, guys...nobody is at fault here, it's simply natural selection at work here; survival of the fittest. The mother wasn't paying attention and the kids foolishly ran into the street. Sorry to say it, but this type of things happens all the time. Depressing? Yeah, but that's life so it's something we should all expect by now. I'm not saying the kid had it coming; however, if he wasn't very smart then something like this would have happened eventually. Honestly, children are stupid; that's why they can't vote or drive cars. Once you make it past age 10 then I'll give you some credit, the infant death rate used to be a lot higher so compared to that kids like my brother are fucking living, breathing miracles. Yeah, that's all I've got. =P

I would say they are both to blame but it is the mothers fault more. thats my opinion tho
