View Full Version : Sex role playing illegal in USA?

I tried to find a general place to ask about this but I couldn't find, since my friend told me about this I decided I'd put this in here (if okay?) well he told me this anyway.

So my friend said to me that it's illegal to do sex role playing so basically if I go to skype and chat to my friend about sexual stuff like pretend we've sex but of course in reality we don't. So he claims that it's illegal to do that....just like in person. . .

so skype chat sex = same as if I'd have sex in person?

So apparently in America you can find from the law book a point where it says something like "sex role playing via computer is illegal?"

First of all, regardless of whether it's legal or not, the chances of any real-life implications from a breach like that are ridiculously slim.
Second of all, I'm fairly sure it varies from state to state. It probably isn't illegal in most, but every state has its own stupid laws so you never know.

Well I've my doubts that this whole thing is just trolling.

1. in Role play you don't touch the person in real life or do anything in real life. So why would the police be interested in that rather than those who actually have sex in real life like rape?

2. My friend never told where he even got the idea that this is illegal..apparently he has a lawyer that said it's illegal..?

3. Would it be more safe that friends do this than rather actually have sex? Which is more harmful reading a text from your computer screen or actually having sex then feel bad afterwards? (of course if both want to have sex but then they can of course feel bad afterwards still)

There are places that like to put limits on what information you can and cannot convey to another person online. You do have some very good points there.

something about role playing sex (http://en.wikipedia.org/wiki/Cybersex)

The only reason they got jailed and got fines to pay was because they send nude pictures of them selves to each other. (http://en.wikipedia.org/wiki/Sexting)

In the Cybersex it doesn't say anything about being illegal

and in sexting the teenagers got jail or fine because they send each other nude pictures of them selves not because of text. . .

so I'm starting to feel like my friend lied to me.

...or, your friend was just misinformed. But yeah, he was probably trolling. Sorry.

To be honest. This is a gray area. While it may not be a law written in stone people have gotten into trouble for doing sexual role play online and various other things. It is a gray area, while most likely your friend possibly was trolling you maybe he had a reason for it.

My advice would be to stay away from doing things like this, you never know where or what it could lead too as it is a sketch activity.

yeah I think he had a reason to troll me but it had nothing to do with this at all....what's wrong with that if two friends decide to do this? just like doing "experimenting" honestly I think that "experimenting" would be worse than just texting to friend saying sex stuff..

It's not illegal to roleplay sex so long as no one gets terribly hurt.
Cybersex, if you're underaged could be illegal. I'm not sure. But people webcam sex with their partners here.

You can do it with your friend here, if they live in the US, so long as they are of the age of consent of the state they're living in and a resident of the state that they're in. I advise you also check your laws regarding sexual activity on the internet.

Sex role playing is cyber-sex. It's very very common in chat rooms on the internet, but very risky. You can't tell if who you are talking to is a minor or not. Some places do put restrictions on it, but there are also places online that are STRICTLY adult oriented and singled out just for that. So I'm pretty sure it's not illegal unless you are underage and lie about it. It's when you go beyond the "hidden behind the screen" deal that it gets out of hand.

Its not illegal for two consenting adults to engage in cyber sex, phone sex, or even webcam. Seeing that you are 18 and an adult if you did do that with another adult there would not be any implications for that.

However if you as an 18 year old had a cyber sex chat with a 14 year old for instance, that can be grounds for sexual misconduct with a minor. As long as someone does it with someone within the confines of the age of consent, you aren't breaking any laws.

Now when it comes to pictures and webcamming, any distribution of that for anyone under 18 is illegal. That is considered child porn. Like for example in my state the age of consent is 16. Theoretically a 45 year old could have legal sex with a 16 year old.. Yet if this 45 year old had a naked picture of this 16 year old on his computer, he's charged with child pornography. If they cammed together it would be the same thing. Yet if they had sex in person it would be legal.

Laws regaurding sex can be very confusing. As an 18 year old adult stay away from anyone 17 or under. Or better yet don't do it at all. Sex shouldn't involve a computer or a cell phone.

SO if me and my friend would have a sexual role play in skype so I'm 18 and his 17 I could end up in jail for what? ...

Sexual misconduct with a minor most likely.
In the federal government of the U.S.A's eyes, your friend's a minor.
If he's in my state, the age of consent is 16. Meaning you two could engage in sexual activity and it'd be legal. But no pictures of videos, that's misconduct with a minor.
Just like Maverick said.

I would guess it's illegal for like minors

Okay so let's say me and my friend who's 17 would text each other sexual stuff like pretend we would have sex. We would only use our phones so no pictures, webcam, videos, pictures anything only text in our phones.

And if somebody finds out about this they're going to throw me to jail or something BECAUSE I've done sexual misconduct? even tho I never touched or done anything to him in person... if it's like that..how stupid is it?

EDIT: LOL so if

17 x 18 have sex in person = it's legal

17 x 18 send each other text messages from skype = illegal

oh god the logic..

I have no idea what you're talking about anymore to be honest, I thought you were talking about webcam. If you're texting, and it's just texts, then no you can't be thrown in jail. If you expose yourself on camera to a minor there could be consequences.
But I don't know how Finland works.

For your 17x18 year scenario. No it wouldn't be illegal, it's texting there's no images involved.

The whole time I've been talking about is only text not images, no videos, no webcams etc ONLY TEXT.

For example in skype if you type stuff that is sexual explicit. No images, video, etc only text on screen that's the question is that illegal or not.

Like image a scene that me and my friend we would both know each other in person it would be some night time and we're both horny. We would start typing each other text that is sexual explicit like how we'd have sex and stuff.

That's what I mean is that illegal? even tho if my friend would be 17 and I'm 18.

I'd say it's not illegal. I'm not certain, but it's more than likely not illegal.

If you knew them then it would be okay.

However if two people who met online were doing it, even if they said they were 18 then it would become problematic, you could possibly face legal charges sending on where you came from.

Overall cyber sex can be a gray area topic. It is popular online and that is where I think the stigma comes from, as you hear all sorts of stories.

"experimenting" in terms of teenage years is fine again with doing it with someone who is 18+ with 14 year old would be a different story.

Like I said cyber sex or role play can be a gray area topic that carries a lot of social or personal stigma.

Of course it is.

Tho I did some research and couldn't find any cases of someone arrest for having cyber sex
