View Full Version : N.J Woman Sues 11 year old Little League Catcher

''In cranky old woman news, a New Jersey woman who was hit in the face by a rogue baseball while in attendance at a Little League baseball game has filed charges against the 11-year-old boy who was responsible for the misfire.

Elizabeth Lloyd was struck by the baseball when she was sitting at a picnic table near the fenced-in bullpen where catcher Matthew Migliaccio was practicing with a pitcher. The lawsuit accuses the young baseball player of assault and battery and causing severe permanent pain to Lloyd.

No one was more shocked to hear the news than Migliaccio's parents themselves. Matthew's father, Bob, admitted that they showed concern for Lloyd at first, but when his son started receiving threatening letters and then papers serving him, the entire situation became infuriating.

"It's absurd to expect every 11-year-old to throw the ball on target," Migliaccio said. "Everyone knows you've got to watch out. You assume some risk when you go out to a field. That's just part of being at a game."

The Migliaccios know they could garner a victory if they opted to fight the charges in court, but the tens of thousands of dollars it would cost them to do so just aren't worth it. On top of that, the Migliaccios aren't receiving any sort of help from Little League in the matter.

Their only hope at this point is that maybe Elizabeth Lloyd will get distracted by her day job of chasing down one hundred and one Dalmatian puppies to make into a fur coat to follow through with the lawsuit.''

I'm not sure whether I should be angry or just sad. This is pathetic. Yes, I feel sorry for the woman, but... uRGHH >.<

I saw this earlier. I couldnt believe it. That woman is a pathetic loser.

You take a chance going to any sporting event, you might get hit by something. You dont sue them. God, he is a 11.

Hopefully a good lawyer takes their case probono and then a judge rejects the lawsuit. The only way it would make sense was if he threw it at her on purpose, also as I understand it the kid doesn't own anything so there would be nothing to sue for but maybe I'm wrong and parents would have to pay.

This would be like suing New York City because you got confetti on you on New Years Eve. You go to a baseball field, baseballs are present, and fields are open. You are supposed to be alert AT ALL TIMES.

Under the age of 12 you can't even be charged with any possible intent (not that there is any intention in this anyways)

I predict this to be thrown out of court.

She's such an in-duh-vidual - as has been said at a sportin event there is alwayz dat risk. Lets hope his family counter sue 4 da distress shes caused dat kid. He gave her a ball (accidentally) an she can give him her house.

It should have been thrown out of the court. The defendant would plead "assumption of risk" which means that she was at the baseball game and she should have known the risks of being there (i.e. getting hit by a baseball...). Though it says they're not going to because it's thousands of dollars? But if they don't then they'll lose even more? That makes no sense...

This is stupid though. This woman sounds like a crazy old-ass stuck-up rich bitch who hates everyone
