It depends, where do you live? And if so do you know the age of legal consent for sex there? If its 16, then technically you're fine, (because if he was 16 and you were 13 that would be statuotary rape), but as I said it depends on the age of consent where you live. If you feel you're ready for sex, then go for it.

Personally I don't think your ready for it yet... although today many kids are doing it younger. But if you do decide to, use protection, also you may want to check your states age of consent to be safe. Aswell as making sure you don't get caught regardless, because even though you may want to do it, he is older and whoever may catch you will blame him and he will get in deep shit most likely, you will to, but he will be held more responsible because he is older (like 2 years is much of a difference..)

In Canada, you can have sex with anyone who is within 4 year range of your age once you reach the age of 14. There's something about anal still being illegal until 18 though... But that doesn't make any sense to me. There was also something about "if you're 13 and have sex with someone 15 or under, no legal action will be taken."... Anyway.. That probably won't apply, 'cause chances are you're not Canadian.

Anyway, back on topic... It's probably illegal where you live... But, as the old saying goes, 'what mama don't know, don't her mama'. Basically, sex is one of those crimes that if you don't confess to a cop, chances are they won't/can't care.
