Default Can Donald Trump Pardon Himself

Couple simple questions
1. Can Donald Trump pardon himself?
2. If he actually end up pardoning himself would you be fine with it?

1. Donald Trump cannot pardon himself.( what would he be convicted for?)

2. Seeing you can only be pardoned after you have been found guilty, that's impossible.

Why do people believe that killing people isn't okay, but killing innocent baby or fetus inside the womb is okay? and vice versa?

I doubt the president could pardon himself legally, and even if he could, him doing so would almost result in an impeachment by Congress, so in all practicality, I doubt the president could pardon himself and continue being president. So no.

This reminds me of some speculation by conservatives prior to the election, about whether or not Clinton could pardon herself if convicted in office. It is funny how everything seems to turn back around.

Fraud, sexual assault, obstruction of justice, etc. who knows with that guy.

Not necessarily, he could confess a crime.

If he does it, it would be because he knows the end of his presidency is near and will soon be impeached.

The actual legality of it is a grey area (the reason why we're discussing it). However, I'd really advise not to. You CAN pardon someone of a crime they have not been convicted of, but all that does is make it perfectly clear that they DID do the crime. It would also be political suicide as even your own party would refuse to stand with the President who backdoor-confessed to a crime and pardoned himself.

The reason we're discussing it is because there is a strong possibility he might try it.

It isn't possible because of Presidential legal immunity. In the office, he can't be sued for a crime in general. The only way to make him liable is to impeach him, which would make him no longer a President with legal authority to pardon. So, he can't pardon himself in the end.

Funny. It's about as strong a possibility of him pardoning himself as you are to give a satisfactory answer to any of the questions in the Free Speech thread.

Don't understand your logic here. I was saying that I am pretty sure he can't legally do if, but in the small chance he is legally able to do it, it would result in immediate impeachment.

Not surprised. Only floated around conservative circles and sites, I don't imagine you as someone who ventures much further right than msnbc and BuzzFeed.

I seriously doubt that he will be charged with any crime. He has said and done some awfully stupid things and if he would limit and control himself with the tweets he sends out it would sure help him. Also the press has been slanted against him since back when he announced his candidacy for president. They take every chance to make him look bad. Grant you he puts his own foot in his mouth enough but he is a very different person not a politician trying to be president in a style and way that he is. I think he deserves to be given the chance to do his job. Congress sure haven't been doing their jobs for over 20 years. It's about time they all pull their heads out of their asses and get to work together to solve the issues and problems before them and get this country united again and end all the protests and violence and discrimination in this country.

I am gay and happy with that.

I voted yes because I think that he could without any type of negative consequence. And I don't know who could possibly stop a President from resigning. That doesn't mean that I'll forgive him or his supporters.

If it's possible for a president to pardon himself, is there anyone more likely to try than Donald Trump?

So if Trump tries to pardon himself you would be for impeaching him?

Given that Trump is the only sitting president atm, I guess I have to say yes to that question

Probably. But I was referring to Republicans in Congress.

I meant of all the previous presidents before him and all possible future ones.

Yes, it's possible. The US's constitution wasn't written with the idea of someone so corrupt in mind. However, if he attempted it... the consequences would be severe for the country. I cannot imagine the US could survive that in its current form. The revolt would be overwhelming.

Given that none of the previous presidents did it, probability dictates that there is more of a chance that Trump would pardon himself. And I can't predict the future, so I can't say.

It's a constitutional crisis.

It was always expected by the founding fathers, that the position of the job itself would be held by a human of good character not to stoop so low.

As the law is written now, yes I believe he can. Unless Congress exercises new laws restricting the authority of the office.

But given that WW3 is about to break out this might be rendered irrelevant or smaller potatoes than what is coming.

Donald Trump would have no need to pardon himself, given the fact that he has not committed a crime to this point.

Last time I checked sexual assault, obstruction of justice and fraud are crimes. And he admitted two of them.

The President cannot pardon himself if he is convicted by the Senate of Impeachment. Under Article II, Section 2, of the Constitution, the President is prohibited from pardoning anyone convicted of Impeachment. It can be assumed that this also applied to him as well.
